Terms and Conditions

In confirming , the Sponsor agrees to abide by the following terms: 

1. General Terms 

1.1 Full payment terms are 14 days from contract date.  

1.2 The organisers reserve the right to withdraw a sponsor involvement and branding if payment is not received within 30 days of contract. 

1.3 The organisers reserve the right to alter the content, platform and specification of the sponsorship at any time, within reason.  

1.4 No refunds of sponsorship will be offered once commitment and payment has been received.  

1.5 Any attendee lists provided is subject to our privacy policy and global data protection laws and may restrict the information given. Note: only those that have ‘opted in’ to the attendee list for sponsor communications will be forthcoming.  

1.6 These terms and conditions are subject to change without notice.  

1.7 DBEI retains the right to cancel any partnership agreement where the actions of a sponsor bring DBEI or its patrons into disrepute.  

2.  Virtual Events & Webinars 

 2.1 Should a sponsor cancel participation more than 6 weeks prior to sponsored virtual event/webinar, a full credit, less a 20% administration fee will be provided. This credit will be valid for any DBEI product or service 12 months from the date of cancellation notification. Cancellations received inside of 6 weeks will not be eligible for a refund. 

2.2 If the event does not proceed on the proposed dates for any other reason apart from Force Majeure (Act of God such as an earthquake, fire, flood, or civil disturbance – typically a symptom of, and a form of protest against, major socio-political problems, widespread disease or other public health emergency – including pandemic or epidemic), a full credit will be provided – valid for any DBEI product or service 12 months from the date of cancellation notification. 

2.3 In the case of Force Majeure rendering the running of the event impracticable, the Organizer will commit to running the event within 6 months of the originally scheduled dates. 

2.4 The Organiser makes no warranty as to the number of attendees and/or viewers that may attend/view the live event or on demand event library. 

2.5 Sponsors understand they will not receive a downloaded file of any recorded events or webinars, (except for Sponsor Content webinars ie. Discover by DBEI webinars), however they will have access to a link to stream the recordings and must adhere to the conditions of re-use policy provided with the downloaded file. It is the responsibility of the sponsor to ensure they have the relevant hardware and reliable, high speed internet connection to ensure effective participation in virtual events and webinar environments. 

3. Conference (In-person) events 

3.1 Booth Preference will be given to higher-level sponsors (Diamond, Platinum and Gold) for exhibition booth positions when the floorplan is first made available, remaining positions allocated in order of receipt of booking and payment. 

3.2 No package or stand reservations will be confirmed without payment being received. 

3.3 Sponsors and Exhibitors agree to comply with the exhibition schedule and other operational instructions and directions as may be made by the Organisers. 

3.4 Any space reserved but not paid in full by four (4) weeks prior to the event can be considered as a cancellation, and any/all deposits forfeited, and the below cancellation terms will apply. 

3.5 Please note that a no-show to the event will still be considered as a cancellation and therefore the below terms apply. 

3.6 The organisers reserve the right to alter the design, location, and specification of the exhibition as circumstances may require. 

3.7 The organisers, exhibition venue and their agents accept no responsibility whatsoever for any injury, damage, lost property or other loss suffered by any exhibitor, their staff or agents, visitors, participants or attendees in connection with the conference/event and/or trade exhibition. 

3.8 Exhibitors are required to provide their own insurance to cover these and other risks and supply a certificate of currency issued by your insurer. 

3.9 Sponsors/Exhibitors shall be liable for any damage or loss caused by them, their staff contractors and/or agents. 

3.10 Should a Sponsor or Exhibitor cancel participation more than 12 weeks prior to the sponsored event, a full credit, less a 20% administration fee will be provided – valid for any DBEI product or service 12 months from the date of cancellation notification. Cancellations received inside of 12 weeks will not be eligible for a refund. 

3.11 DBEI or its agents shall not be liable for any loss caused by the cancellation of the conference where such cancellation is due to Force Majeure. The organizers will use all reasonable efforts to conduct the conference despite the intervention or occurrence of any such cause. In this clause, Force Majeure means circumstances which are beyond the reasonable control of DBEI and which are reasonably likely to affect DBEI’s successful delivery of the Event or would make it inadvisable, impracticable, illegal, or impossible for a party to perform its obligations as originally contracted under this Agreement, including: fire, flood, earthquake, extreme adverse weather conditions, failure of electric power, gas, water, or other utility service, collapse of building structures, widespread disease or other public health emergency (including pandemic or epidemic), strike or other industrial action, the outbreak or declaration of war, act of terrorism, revolution or government orders or action (including the declaration of a State of Emergency). If, as a result of Force Majeure, DBEI cancels the Event/s, DBEI shall use reasonable commercial endeavours to reschedule the Event within 12 month of the original dates. 

3.12 CANCELLATION POLICY:

Postponement
a) In the event of postponement by the DBEI, the Sponsorship & Exhibition Managers or the ICC Sydney all Sponsorship & Exhibition bookings will be carried over to the revised Event dates.

Cancellation by Organisers

a) In the event of cancellation by the DBEI, Sponsorship & Exhibition Managers or the ICC Sydney all Sponsorship & Exhibition payments will be fully refunded subject to deduction of any credit card or bank fees that the Host or Sponsorship & Exhibition Managers may incur.

COVID-19 implications

a) Should a Sponsor and/or Exhibitor’s attendance to the Event be impacted by any restrictions enforced by COVID-19 government regulations, the Organising Committee will discuss the available options on a case by case basis and come to a mutual agreement with the Sponsor and/or Exhibitor.

Cancellation by Sponsor or Exhibitor:

a) In the event of cancellation by the Sponsor or Exhibitor (other than as a consequence of any restrictions enforced by COVID-19

government regulations), a full credit will be provided – valid for the new conference date or any DBEI product or service 12 months from the date of cancellation notification.

Should a cancellation be made prior to payment, the appropriate cancellation fee will be applicable, and the Sponsorship & Exhibition Managers will issue an invoice which will be payable within seven (7) days. No sponsor shall assign, sublet or apportion the whole or any part of their sponsorship package except upon prior written consent of the Sponsorship & Exhibition Managers.

 

3.13 The Organisers make no warranty as to the number of attendees and/or visitors that may attend the event/conference/exhibition. 

4. Hybrid Events (single event where attendees are given the opportunity to participate in-person or in a virtual capacity) 

4.1 All terms within sections 1, 2 & 3 apply, as relevant.
